This original application has been registered under Section 14& 15 of the National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) on a letter petition received from Dr. Smt. Janak Palta McGilligan complaining about pollution of air and water near Omkareshwar in Madhya Pradesh due to construction of ‘Statue of Oneness’. The said construction is going on near Omkareshwar Jyotirling Tirth, Madhya Pradesh. It is alleged that for purpose of construction of said statue, more than 1000 trees have been cut. The land upto 30-40 feet has been dug by using heavy machines without following scientific methods causing huge damage to the top soil and debris of the construction is being dumped in River Narmada causing damage to aquatic life. It is also alleged that sewage is directly being discharge in River Narmada causing health 2 hazard to local residents and ecological disturbance is also being caused due to damage caused to the hilly track for the construction. In support of complaint, photographs have been appended with letter petition. Perusal whereof shows that debris of construction material have been dumped in river path and logs of trees also shows cutting of huge number of trees.

Mining is being conducted in violation of Sustainable Sand Mining Management Guidelines, 2016 and Enforcement & Monitoring Guidelines for Sand Mining, 2020 issued by the MoEF&CC, without the annual replenishment of sand in the mining lease area, sufficient to sustain the mining operations at levels prescribed in the mining plan, mentioned in granted EC.

The applicant has sent the present letter petition, which has been treated and registered as original application, complaining about Mega construction activities in eco-sensitive zone of Pench Tiger Reserve Seoni, Madhya Pradesh roughly 200 meters from the core area boundary at Awarghani Rayyat village, Khawasa buffer near Turiya Gate, Madhya Pradesh. The applicant has submitted that a huge artificial pond is being constructed and the mud from the same is being used to create a hill slope (12ft. high) around the border wall running across several acres. The construction site is surrounded by a high fencing secured to the cemented boundary wall and is being monitored by flying drone over the same. The construction violates various provisions of the Gazette Notification dated 06.11.2019 of Eco-sensitive Zone (ESZ), Pench Tiger Reserve Seoni, Section 38V-3(b) and Section 38(o) (1) (g) of the Wildlife Protection Act, 1972,. Vehicular pollution is being caused by emissions from construction vehicles plying in ESZ. Heavy earth moving machinery in operation also blows huge cloud of dust to nearby core area of park. Mud from the nearby construction will clog Nala flowing adjacent to the site. The area very close to the core area boundary is being diverted for ecologically unsustainable uses and the high mud slope barriers will obstruct tiger dispersal and will also affect their breeding habitant within protected area.

a. State governments to set up a robust mechanism of
surveillance for addressing the issue of illegal/informal
processing of e-waste in their State.
b. The leakage of e-waste from authorized dismantlers/
recyclers is one of the major attribute for e-waste to reach to informal sector. It has been observed that
dismantlers/recycler have been given processing capacity
beyond their actual processing capacity and the same
leads to leakages. SPCBs/PCCs to ensure capacity of the
dismantlers and recycler as per the guidelines of CPCB
c. SPCBs/PCCs to plan and execute random inspection
and audit of authorized E-Waste dismantling and
recycling units for assessing the material balance in
terms of quantity of e-waste collected, quantity of ewaste dismantled/recycled vis a vis quantity reported
so as to ascertain and prevent leakage of e-waste to
informal sector. The inspections and audit should focus
on checking quantities of different materials produced
such as precious/semi-precious and useful metal from
E-Waste. SPCBs/PCCs to ensure that the dismantling
and recycling unit are having adequate dismantling and
recycling facilities in line with guidelines of CPCB.
d. SPCBs/PCCs to carry out random monitoring and
compliance of Extended Producer Responsibility (EPR)
Authorisation of EPR Authorized Producers with focus on
verification of collection targets.
e. Bulk Consumers as defined in the rules should
channelize their e-waste only to Producer's system of
collection or authorised recyclers/dismantler.
f. All SPCBs/PCCs to implement Action Plan for
enforcement of E-Waste (Management) Rules, 2016
with focus on action points related to informal trading,
dismantling, and recycling of e-waste, Producer's
systems for collection & channelization, quantity of ewaste collected towards fulfilment of collection target
and submit reports quarterly on the outcome.”
9. We see no reasons not to accept the recommendations in the report
of CPCB quoted above. We direct that the same be strictly followed by all
the State PCBs/PCCs. CPCB may further monitor compliance atleast
twice a year by holding VC with the Member Secretaries of all
PCBs/PCCs.
